Terms of Service

By placing an order or using the services provided by Song For You, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services. Song For You is a trading identity of SMEATON & CO LTD (Company No: 07409342), registered at 70 Market Street, Dalton-In-Furness, England, LA15 8AA.

Orders may only be placed by individuals aged 18 or over. By placing an order, you confirm that you meet this requirement.

We provide a bespoke song creation service. We transform the personal memories, names, and details you provide into original, professionally produced musical compositions. Each song is crafted specifically for you and is unique to your order.

• All prices are displayed in GBP (£) and include VAT where applicable.
• Full payment is required via our secure Stripe payment system before production begins.
• Your order is confirmed upon receipt of payment, at which point a confirmation email will be sent to the address you provided.
• We reserve the right to decline or cancel an order at our discretion. If we cancel an order, a full refund will be issued promptly.

To enable us to produce your song, you are responsible for:

• Providing accurate, complete, and truthful information in your order brief.
• Responding promptly to any queries from our team regarding missing or unclear information.
• Ensuring that any names, dates, events, or personal details you submit are correct.

We are not responsible for inaccuracies in the finished song that result from incorrect or incomplete information provided by you. Where an error originates from information you submitted, any correction may be subject to an additional charge. Where the error is ours, we will correct it at no cost under our quality guarantee (see clause 7).

You may not use our service to commission content that is defamatory, harassing, threatening, obscene, or otherwise unlawful. We reserve the right to decline or cancel any order we reasonably believe falls into these categories, in which case a full refund will be issued.

Where an order has been produced in good faith based on information provided by you that later proves to be false, misleading, or harmful in nature, we accept no liability for any consequences arising from that content.

6.1 Standard Delivery Timescales

• Classic (£24.99): Delivered within 72 hours
• Portrait (£39.99): Delivered within 48 hours
• Signature (£59.99): Delivered within 48 hours
• Rush Delivery (+£30): Delivered within 24 hours

6.2 When the Delivery Clock Starts

Once your order brief is complete, we will send your full lyrics for review by email, with a text message letting you know they are ready. Your response to that review is your final sign-off. You may either approve the lyrics as written, or submit your changes in the review form — if you submit changes, your amended lyrics become the final confirmed version and your order proceeds straight to production. There is no second approval round.

If we don't hear back after sending your lyrics:

• We will send reminders by email and text at 24, 48 and 72 hours after the lyrics were sent.
• At 96 hours, your order will be placed on hold and we will notify you by email and text. While on hold, no further automatic reminders are sent.
• An order on hold resumes as soon as you respond — nothing is lost.
• If we have received no response within 7 days of sending your lyrics, we will close the order and issue a full refund to the original payment method. We will notify you by email before closing the order.

Signature media: if your lyrics are signed off but your media collection remains unconfirmed, we will send reminders and then contact you personally rather than closing the order automatically — you have already approved your song, so we will always try to reach you before taking any further action.

For all packages, if our team needs to clarify missing or ambiguous information before preparing your lyrics, that process must be resolved before the lyric review stage can begin.

6.3 Rush Delivery

Rush delivery is available at checkout for an additional £30 and applies a 24-hour turnaround from your lyric sign-off (for the Signature package, from the later of lyric sign-off and media confirmation, as set out in clause 6.2). Rush delivery cannot be guaranteed where a query on your brief remains outstanding at the time the order is placed.

6.4 Digital Delivery

Your song will be delivered digitally to the email address provided at checkout. Delivery is deemed complete when we send the file or download link to that address. We recommend downloading and saving your file promptly. Download links remain active for 30 days from the date of delivery. Re-delivery of expired links may be subject to a small administration charge.

We are not responsible for delivery failures caused by an incorrect email address provided at checkout, messages blocked by spam filters, or any other circumstances beyond our reasonable control.

6.5 Delays Beyond Our Control

We are not liable for delays caused by circumstances outside our reasonable control, including but not limited to technical failures, illness, or events of force majeure. In such cases, we will notify you as soon as reasonably practicable and deliver your song at the earliest opportunity.

7.1 Statutory Exclusion

In accordance with Regulation 28 of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the standard 14-day cooling-off right does not apply to goods that are clearly personalised.

7.2 Cancellation Before Production

If you wish to cancel your order before production has commenced, please contact us immediately at hello@songforyou.co.uk. Cancellations requested before our team has begun work on your brief may be considered at our discretion. We will endeavour to respond to all pre-production cancellation requests within 4 business hours. Once production has started, orders are final as set out below.

7.3 Final Sale

Because every song is crafted bespoke to your brief, all orders are final once production has commenced. We are unable to offer refunds for a change of mind once work has begun. You will, however, never receive a song you have not signed off: we send you the full lyrics before any recording takes place, and production does not begin until you confirm them — either as written or with your changes applied (see clause 6.2). If we are unable to reach you to confirm your lyrics despite reminders at 24, 48 and 72 hours and your order being placed on hold at 96 hours, we will close your order 7 days after the lyrics were sent and issue a full refund to the original payment method (see clause 6.2).

7.4 Our Quality Guarantee

We are committed to delivering a song that accurately reflects the information you provided. If our team makes a factual error — for example, misspelling a name or omitting a detail that was clearly stated in your brief — we will correct it at no extra cost. Corrections will typically be completed within 48 hours of your request being received.

This guarantee applies only to errors that are our responsibility. It does not apply where inaccurate or incomplete information was provided by you (see clause 4).

Every package includes one round of revisions at the lyrics stage, at no additional cost. Your included round is the set of changes you submit together in the lyric review form at sign-off: request as many changes as you like in that single submission, and your amended lyrics become the final version that goes into production.

After sign-off, further revision rounds are available at £10 per round. Payment is taken before the round opens, and one payment covers one full batched set of changes. A revision means amendments to lyrics, musical style, or production details within the scope of your original brief; requests that materially change the song's concept, occasion, or recipient may be treated as a new order. Post-delivery revision requests must be submitted within 14 days of delivery.

Factual errors are always corrected free of charge, at any stage, in any round — if we have misspelt a name, missed a detail that was clearly stated in your brief, or otherwise failed to reflect the information you gave us, the correction is covered by our quality guarantee (clause 7.4) and is never subject to a revision charge.

9.1 Company Ownership

All audio files, lyrics, melodies, stems, and associated production materials used or created in the production of your song remain the exclusive intellectual property of SMEATON & CO LTD.

9.2 Personal Use Licence

Upon receipt of full payment, you are granted a perpetual, non-exclusive, non-transferable licence to use the final delivered song for personal, non-commercial purposes, including sharing with family and friends, playing at private events, and sharing on personal social media accounts.

9.3 Commercial Use

Any commercial use of your song — including use in advertising, monetised social media content, broadcast, sync licensing, or any revenue-generating activity — requires a separate commercial licence. Please contact us at hello@songforyou.co.uk to discuss commercial licensing options.

9.4 Customer-Supplied Materials

Where you supply photographs, voice recordings, or other media as part of your order (for example, for inclusion in a video montage under the Signature package), you warrant that you own or have the appropriate rights to use all such materials, and that their use by us in fulfilment of your order does not infringe any third-party intellectual property rights. We accept no liability for any copyright or intellectual property claim arising from materials submitted by you. Any such claim will remain your sole responsibility.

9.5 Our Marketing Rights

By placing an order, you grant Song For You a worldwide, royalty-free licence to use the produced audio, excerpts from lyrics, and anonymised details for marketing and promotional purposes, including on our website, YouTube channel, and social media platforms.

9.6 Privacy Opt-Out

If you wish for your song to remain private and not used in any marketing or promotional material, please notify us at hello@songforyou.co.uk at the time of ordering or as soon as possible thereafter. We will honour all valid opt-out requests promptly.

If you are unhappy with any aspect of your order, please contact us in the first instance at hello@songforyou.co.uk. We aim to respond to all complaints within 2 business days and to resolve them fairly and promptly.

If you are not satisfied with the outcome, you may refer your dispute to an Alternative Dispute Resolution (ADR) scheme. We are not currently members of an ADR scheme, but you can find information about approved ADR providers in the UK at https://www.gov.uk/find-ombudsman.

We handle your personal data in accordance with our Privacy Policy. By placing an order, you agree to our collection and use of your data as described in that policy. We comply with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

Our maximum liability to you in connection with any order is limited to the amount paid by you for that order.

Nothing in these terms excludes or limits our liability for:

• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Any other liability that cannot be lawfully excluded or restricted under English law

We reserve the right to update these Terms of Service at any time. Updated terms will be published at songforyou.co.uk/terms with a revised "last updated" date. Orders placed before any update will be governed by the terms in effect at the time of purchase.

These Terms are governed by the laws of England and Wales. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
